THE LEGISLATION
Colombian Legislation
Surrogacy (Surrogate Pregnancy) although it is not yet specifically regulated by Colombian law, is delimited by the provisions of the Constitutional Court set forth mainly in the T-Decision 968 Of 2009 in which it was established as general requirements and conditions: that the intentional parents have physiological limitations to conceive; that the gametes required for conception are not provided by the pregnant woman (who facilitates their womb; that the motive of the pregnant woman is not to make a profit but to help others; that the pregnant woman meets a number of requirements such as age, mental health, having children, being able to become pregnant, that the pregnant woman is obliged to undergo appropriate examinations before, during and after pregnancy as well as psychological assessments; that the identity of the parties is preserved; that the pregnant woman, once she has signed the informed consent and the reproductive material or gametes have been implanted, cannot retract from the delivery of the baby; that the biological (intentional) parents may not refuse the child under any circumstances; that the death of the biological parents before birth does not leave the minor unprotected; and that the pregnant woman could only interrupt the pregnancy by medical prescription and those prescribed by law under the understanding that before, during and after, your autonomy to dispose of your own body will be respected.
The subrogation process is completely legal, for this it is necessary that all involved avail themselves of the Colombian laws especially those that protect children.
As for the management given by clinics or fertility centers in Colombia, there are also some established parameters in which it is possible to carry out this type of fertility treatments in a healthy, reliable and safe way.

Our program has been socialized directly with the US embassy and Colombia immigration staff in the city of Barranquilla.
We commit ourselves to ensuring strict legal support so that families are legally protected, that the process is carried out with full transparency, security and respect for the rights and well-being of all participants, providing a safe process, which today has allowed us to be leading legal advisors and consultants at the global level in shaping families through surrogacy.
We help and represent the interests of the intensional parents to seek and obtain links with all those allies in the health sector and with the surrogate mother. However, it should be noted that the surrogate and all professionals involved in the process will be responsible for their own autonomy, quality of service, professional or personal obligations, performance of their duties, among others.

Start Of The Program (STAGE I)
Signing the agreement: Our lawyers establish agreements to generate a contract that has effects in Colombia, Contracts and consents are drawn up and signed between all parties involved during the whole process, from the beginning of the fertility process until the newborn’s return home with his new family to his country of stay. Our program accompanies parents at any fertility clinic they choose or connects them with any of our partners. Selection of candidate: We search and select the best candidate for the process, which is submitted to medical and psychological evaluations, besides we carry out social studies and legal background. Medical affiliations: Affiliation of the surrogate to the public health system and a private health plan, as a requirement for the fertility clinic to initiate the IVF process.
Pregnancy Outcome (STAGE II)
surrogacy is a highly complex fertility treatment performed in specialized centers with high recognition and experience worldwide, who are responsible for the entire medical scientific process to achieve with a high success rate the desired pregnancy. The medical department must guide all those involved in physical and psychological examinations, especially to qualify as a pregnant (surrogate) woman as suitable
Pregnancy (STAGE II)
During this stage, there is a service associated with a nursing professional who is responsible for the care, Follow-up and management of the pregnancy, indicating step by step the care necessary to bring a pregnancy within normal parameters. We connect parents with all the first-class medical services that are needed to lead a pregnancy-Gestation in the best possible way.
Legalization Of The Newborn (STAGE III)
finally, the legalization of the newborn is carried out, which consists in obtaining Colombian citizenship and that of his country of origin (depends on his particular case and nationality), custody, fixing of travel permits (leaving the country), custody in favor of the parents and/or mothers and subsequently remove the pregnant woman as legal mother of the baby in Colombian documents.

Learn the new terms that will make your dream come true
They are those who contribute or not genetic material (eggs or sperm) that wish to carry out the process of uterine surrogacy with the purpose of having a child(s).

RESPONSABILITY
Responsibility Of The Intentional Parents
The intensional parents must take into account all the risks involved in the process of surrogacy:
The probability of pregnancy on the first attempt of IVF (In Vitro Fertilization) is not guaranteed by any fertility center worldwide and sometimes it is necessary to repeat several cycles of IVF until the pregnancy is achieved. To achieve success, the percentages of probabilities according to your particular case should be taken into account.
That pregnancy as such is a stage that marks the life of a woman through various physiological and psychological changes. This poses significant risks which remain present even if all possible precautions are taken and these factors are taken into account.
That, although risk factors are carefully taken into account during pregnancy and delivery, it is still possible for malformations or conditions to occur in the baby due to spontaneous genetic mutations without clear cause, and are unpredictably out of control by the surrogate mother, the intended parents and health care professionals. They cannot therefore refuse to assume their child regardless of his or her physical or morphological characteristics or conditions.
That the surrogate woman participating in the program lends her biological strength of gestation freely and voluntarily, at all times she is guaranteed respect for her personal privacy, personal beliefs, religious, fundamental rights, sexual, reproductive and their power of decision, self-determination and free choice over their body and health.
The program’s counsel are obliged to act, act and guarantee their own compliance with requirements under the Code of Professional Ethics and laws that guarantee responsibility and integrity in the practice of law, and will never be so for the actions of third parties. Each of the parties involved in the process such as: parents, surrogate mothers, fertility clinics, doctors, nursing service, among others is individually responsible for the performance of their duties, functions and duties.
